Identification of FUERA DEL MOLDE
FUERA DEL MOLDE® is a commercial establishment of Grupo Tecnológico CATO S.A.S., a Colombian company identified with Tax Identification Number (NIT) 900.494.361-8, with mailing and business address at CL. 152 # 72-03, Tower 4, Bogotá D.C., and address for service of judicial notices at Calle 45A # 53-51, Barrio Virrey, Villavicencio, Meta. Contact telephone numbers: 310 283 6520 and 314 481 6215. For purposes of these Live Shopping Terms and Conditions, it may be referred to as “FUERA DEL MOLDE”, “FDM”, “we”, “our” or “us”, as applicable. The customer service email is [email protected].
FUERA DEL MOLDE may conduct live commercial broadcasts or Live Shopping through the Marketplace, its websites, applications, social media, streaming platforms or other enabled official channels for the purpose of presenting Products, designs, collections, customization processes, brands, creators, promotions and other experiences related to FDM Services.
These Terms establish the general conditions applicable to the operation of, participation in, and purchases made during such broadcasts. They must be interpreted together with the general FUERA DEL MOLDE Terms and Conditions and any other policies, agreements and conditions applicable to each participant, Product, Promotion and Order.
1. Purpose and Scope
These Terms govern FUERA DEL MOLDE’s commercial Live Shopping format, through which FDM may present Products, designs, collections, Services, customization processes, demonstrations, offers, promotions or other commercial experiences in real time and facilitate viewers’ access to official purchasing mechanisms.
Depending on the nature of the activity, these Terms may apply to viewers, Buyers, Commercial Users, Sellers, Artists or Designers, Manufacturers or Producers, Printers, presenters, content creators, Influencers, brands, partners, guests and other authorized participants.
Participation in a Live Shopping session does not by itself change the legal role performed by each participant in a transaction or expand the activities for which a Commercial User has been enabled. Obligations and responsibilities will be determined according to the role actually assumed, the Order conditions, applicable agreements and applicable law.
Merely viewing a Session, submitting comments or interacting with a broadcast does not by itself constitute a purchase or acceptance of additional commercial obligations other than those applicable to use of the Streaming Channel or Marketplace. Where participation by a Commercial User, Presenter, creator, Influencer or partner requires acceptance of special conditions, FDM must provide a reasonably verifiable mechanism before such obligations are assumed.
2. Relationship with Other FUERA DEL MOLDE Terms and Policies
Live Shopping forms part of the ecosystem of Services and commercial activities that FUERA DEL MOLDE may enable. As applicable, the general Terms and Conditions, the Terms for the Onboarding and Enablement of Commercial Users, the Exchanges and Returns Policy, the Delivery and Shipping Policy, the Intellectual Property and Image Rights Policy, the Content and Community Guidelines, the Privacy and Personal Data Processing Policy, the Partner Negotiation and Categorization Agreement, and any other specific conditions accepted by the parties will apply.
Where a Live Shopping session includes a Promotion, collaboration, contest, sweepstakes, licensing program, launch, presale or other activity subject to specific rules, additional conditions applicable exclusively to that activity may be published. Such specific conditions will supplement these Terms with respect to the matters they govern, without prejudice to the precedence of applicable mandatory rules.
3. Definitions
For purposes of these Terms, the following definitions will apply, without prejudice to any others established in the general Terms and Conditions and FUERA DEL MOLDE policies:
• Live Shopping or Live Shopping Session: a real-time audiovisual broadcast organized, coordinated, authorized or promoted by FUERA DEL MOLDE in which Products, Content or Services are presented and viewers are given access to official purchasing mechanisms.
• Streaming Channel: the website, application, social network, streaming platform or other official or authorized digital medium through which the Live Shopping session is broadcast.
• Presenter: a person authorized to host, moderate or present a Live Shopping session, whether on behalf of FDM or as a guest, creator, Influencer, partner or commercial participant.
• Live Shopping Promotion or Live Promotion: a discount, promotional price, code, coupon, benefit, promotional shipping, additional Product or other incentive expressly linked to a Live Shopping Session and subject to a specific validity period and conditions.
• Live-Specific Conditions: specific information published or communicated for a particular Session or Promotion, including, as applicable, date, schedule, Products, benefit, code, inventory, limits, restrictions, territory, purchasing channel and other requirements.
4. Streaming Channels and Broadcast Formats
FUERA DEL MOLDE may conduct Live Shopping through features of the Marketplace itself or through third-party services, including social networks and streaming platforms. Availability of specific features, such as comments, pinned products, links, reactions, chat, integrated purchasing or rebroadcasts, will depend on the Streaming Channel used.
Where the broadcast takes place through a third-party platform, that platform’s rules regarding use, security and operation may also apply. Use of an external Streaming Channel does not alter the obligations applicable to FDM, Sellers or other participants regarding commercial information, advertising, Orders and Buyers’ rights.
5. Organization and Preparation of Live Shopping
FUERA DEL MOLDE may determine the theme, date, duration, format, channel, participating Products, presenters, guests, commercial dynamics, audiovisual resources and other operational elements of each Live Shopping session.
Before the broadcast, FDM may reasonably verify information regarding Products, prices, availability, variants, customization conditions, preparation times, participants, promotional materials, codes and other elements that will be communicated to the public.
Commercial Users and other participants who provide information for the Live must ensure that it remains truthful, sufficient, clear, up to date and consistent with what can actually be offered and fulfilled. Any material change relating to inventory, production, price, restrictions, rights in Content or fulfillment capacity must be communicated to FDM as soon as it becomes known.
6. Participation of Commercial Users, Brands and Guests
FUERA DEL MOLDE may invite or enable Sellers, Artists or Designers, Manufacturers or Producers, Printers, brands, partners and other Commercial Users to participate in one or more Live Shopping Sessions.
Participation may be subject to specific conditions relating to Products, availability, prices, Promotions, presentation materials, authorizations, schedules, logistics, Order fulfillment, compensation or any other aspect necessary to conduct the activity in an orderly manner.
Participation in a Live Shopping session does not imply exclusivity and does not guarantee any minimum number of viewers, interactions, Orders, exposure, sales or income. Participants must refrain from making commitments on behalf of FUERA DEL MOLDE that are unauthorized or incompatible with conditions validly communicated to the public.
7. Presenters, Content Creators and Influencers
A Live Shopping Session may feature presenters, content creators, Influencers, commercial partners or other guests. Where there is sponsorship, a commission, compensation, free or paid provision of Products, a contractual relationship or another commercial relationship that may influence the content, the advertising nature of the participation and the relevant relationship must be identified clearly, visibly and understandably to the audience, contemporaneously with the promotional message and in a manner appropriate to the format used.
The Presenter must seek to ensure that statements regarding Products, prices, Promotions, availability, benefits, warranties, timing, materials or characteristics correspond to authorized and verifiable information. The Presenter must not present as personal experience, proven fact, certification or guaranteed result anything that cannot reasonably be substantiated.
Any person appearing on camera must have provided the applicable authorizations for use of their image, voice, name or other attributes, according to the scope of the broadcast, recordings and any subsequent uses agreed upon.
8. Information and Advertising During the Broadcast
Information communicated verbally, through on-screen text, descriptions, links, pinned products, highlighted comments, graphics or other Live Shopping resources must be truthful, sufficient and clear and must not mislead regarding the conditions of the offer or the purchase decision.
False or misleading statements must not be made regarding materials, origin, quality, performance, availability, quantity, benefits, previous or reference price, discount, exclusivity, urgency, scarcity, warranty, customization, delivery or any other relevant characteristic. Where a previous price, reference price or savings comparison is used to present a benefit, that information must be truthful and verifiable and may not be artificially constructed to create the appearance of a nonexistent discount or a discount greater than the actual one.
Objective and specific conditions announced during Live Shopping will bind the party making the advertisement or offer in the terms in which they were communicated. Where a purchase decision depends on a material restriction or condition, it must be communicated with sufficient visibility and accessibility within the advertisement or promotional communication itself. Reference to a link, description, pinned comment or a general statement such as “terms and conditions apply” may supplement the information, but may not replace disclosure of an essential restriction where omission could mislead consumers regarding the benefit offered.
If a material error in commercial information is identified during the broadcast, FUERA DEL MOLDE will seek to correct it clearly as soon as reasonably possible. Already confirmed Orders will be handled according to the circumstances of the case, the conditions validly communicated and applicable law.
9. Conduct of the Live Shopping Session
The structure of each broadcast may vary. A Session may include, among other activities, an event introduction, explanation of the purchasing process, Product demonstrations or comparisons, presentation of variants, real-time customization, guest participation, announcement of Promotions, questions and answers, and closing.
Where there is a Live Promotion, FDM must communicate its essential conditions before or at the time it is announced and may provide supplementary information through on-screen text, links, descriptions, pinned comments, dedicated pages or other reasonably accessible mechanisms.
Questions submitted by viewers may be answered during the broadcast where possible. The absence of an immediate response does not modify the published conditions or prevent the User from using official customer-service channels to request additional information.
10. How Purchases Are Made
Unless the Live-Specific Conditions expressly enable another official mechanism, purchases must be made through the FUERA DEL MOLDE Marketplace and its selection, cart, Buyer identification, delivery-address, shipping-method and payment-method process.
Where a third party acts as Seller toward the Buyer, its identity and the information legally required for proper identification and contact must be available in the publication, purchasing process, Order confirmation or another appropriate area of the Marketplace.
Before completing the transaction, the official purchasing process must allow the Buyer to review an Order summary containing the description of the Products, their individual prices, the total price and any applicable additional costs, including shipping where applicable, and to make corrections or cancel the transaction before finalizing it. Acceptance of the purchase must be express, unequivocal and verifiable. Once the transaction is completed, an acknowledgment of receipt and the Order information will be sent within the period and with the content required by applicable law.
Information regarding the right of withdrawal, where applicable, and the procedure for exercising it must remain accessible through the Marketplace and the corresponding policies.
Viewing a Product, interacting with a button, submitting a comment, expressing interest, opening a link or adding the Product to the cart does not by itself constitute a confirmed Order or necessarily reserve inventory, price or a promotional benefit.
A comment such as “I want it,” “save one for me,” “mine,” or any equivalent expression in the chat does not by itself constitute a purchase where the official mechanism requires completion of the Marketplace purchasing process.
As part of the ordinary Live Shopping process, FUERA DEL MOLDE will not ask Buyers to make payments to personal accounts, private wallets or mechanisms that have not been identified as official transaction channels. Full payment-instrument numbers, passwords, authentication codes or other financial information unnecessary to complete the purchase through the official channel must also not be shared in the chat.
The rules on legal capacity to contract, account creation and participation by minors set forth in the general FUERA DEL MOLDE Terms and Conditions will continue to apply to Orders placed in connection with Live Shopping.
11. Prices and Economic Conditions Displayed During the Live
Prices applicable to Products and Services must be clearly stated in Colombian pesos unless, due to the nature or territory of the transaction, another currency is expressly appropriate. The advertised price must include taxes and other amounts legally required to form part of the price. Any additional costs that may apply, such as transportation or delivery, must be disclosed to the Buyer in advance, clearly stating their basis and amount or the mechanism for determining them before the Order is confirmed.
Where a promotional price or discount is announced, the conditions necessary to obtain it must be identifiable and the purchase summary must allow the Buyer to verify the applicable amount before confirming the Order. The Buyer will not be required to assume charges, surcharges or additional amounts that were not disclosed in advance and accepted during the purchasing process, without prejudice to amounts required by law.
The mere appearance of a price in an old recording, screenshot, expired publication or reused content does not extend its validity after the corresponding Promotion has ended. FUERA DEL MOLDE will seek to indicate that temporary benefits have expired where recordings or content remain available after the Live.
12. Exclusive Live Shopping Promotions
FUERA DEL MOLDE may offer exclusive Live Shopping Promotions, including discounts, special prices, codes, coupons, shipping benefits, additional Products, early access or other lawful incentives. The Promotion terms will bind the party offering the Promotion and must be honored throughout the announced validity period.
Each Live Promotion must establish, as applicable, the included Products or categories, the benefit offered, percentage or amount of the discount, required code, start and end date and time, available units or slots where there is a quantitative limitation, limits per Buyer, territory, Streaming Channel, purchasing channel, stacking conditions and any other relevant requirements. Conditions regarding time, manner, place and any other requirement necessary to access the benefit must be clearly communicated to the consumer in the corresponding advertisement or promotional communication.
The expression “only during the Live” may be used as a summarized commercial message where the Live-Specific Conditions make the specific validity period readily accessible. For operational purposes, time will be interpreted by reference to official Colombian time unless another time zone is expressly stated.
13. Validity of Live Shopping Promotions
A Live Promotion will be valid only during the period expressly stated for the corresponding Session or during the specific term indicated in its Live-Specific Conditions.
As a general rule, whether an Order qualifies for a Promotion will be determined by the time at which the Buyer completes the purchasing process and the Marketplace generates the Order within the promotional period, unless the specific conditions establish a different criterion that has been clearly disclosed.
Adding a Product to the cart before the Promotion ends does not by itself guarantee application of the benefit if the Order is generated after the Promotion has expired.
Where the Order and payment request were correctly generated within the validity period and payment approval depends on subsequent processing by the financial provider, FDM may preserve the benefit subject to final approval of the transaction, provided there is no fraud, duplication, expiration of the payment method or another cause attributable to the Buyer that prevents completion of the transaction.
14. Promotional Codes, Coupons and Stacking of Benefits
Certain Promotions may require use of a promotional code or coupon. Where the system requires entry of the code, the Buyer must enter it and verify the purchase summary before confirming the Order.
The Live-Specific Conditions must indicate whether a benefit may be combined with other coupons, discounts, FDM vouchers or Promotions. Unless stacking is expressly permitted, FDM may limit combined use of benefits where that restriction was communicated before purchase.
Codes may be limited by date, time, Product, category, number of uses, quantity per Buyer, territory, channel or any other objective criterion disclosed in advance.
15. Inventory, Slots and Promotional Availability
A Live Promotion may be subject to a limited quantity of Products, variants, units, slots or benefits. Where there is a material quantitative limitation, the Live-Specific Conditions must identify it with sufficient specificity for the Buyer to understand promotional availability. If an expression such as “while supplies last” is used, there must be a defined inventory associated with the Promotion and the information communicated to the public must be consistent with that limitation.
Adding a Product to the cart does not constitute an inventory reservation unless the Marketplace expressly states otherwise. Availability may be updated in real time or at intervals depending on the technical integration among inventory systems, Sellers and the Streaming Channel.
Participating Commercial Users must refrain from showing as available a quantity they reasonably know they cannot supply. If a material change occurs during the Live, FDM may communicate that inventory has been exhausted, withdraw the benefit, limit new purchases or apply the appropriate alternatives to already confirmed Orders.
16. Live-Specific Conditions for Each Live Shopping Session
For each Session, FUERA DEL MOLDE may publish a listing, dedicated Live page, description, pinned comment, link, informational piece or other mechanism containing the Live-Specific Conditions and the conditions of its Promotions. These mechanisms will supplement advertising, but essential restrictions of a Promotion must not be contained solely in a separate document or link where omission from the primary message could alter a reasonable perception of the benefit.
These conditions may specify, among other matters:
• date, start time and end time of the Session or Promotion;
• Streaming Channel and official purchasing channel;
• participating Products, categories, Sellers or collections and, where applicable, the identity of the organizer or offeror of the Promotion;
• price, discount, benefit, code or promotional mechanics;
• quantity of available units, slots or uses;
• limits per Buyer, account, Order or Product;
• applicable territory and coverage;
• rules on stacking with other benefits; and
• any other condition necessary to understand and use the offer.
Where there is a difference between a general rule in these Terms and a specific, clear and valid condition published for a particular Promotion, the specific condition will prevail with respect to that Promotion, without prejudice to mandatory rules and non-waivable consumer rights.
17. Promotions and Compensation of Commercial Users
Inclusion of a Product in a Live Promotion will not automatically reduce the compensation, margin, royalty or other amount payable to the Commercial User participating in the transaction.
Where a Promotion directly reduces a Commercial User’s compensation, that reduction must be covered by conditions previously accepted by the Commercial User or be subject to the Commercial User’s specific acceptance, in accordance with the Onboarding Terms, the applicable commercial agreement or the conditions of the relevant program.
If the promotional benefit is funded exclusively by FUERA DEL MOLDE from its own fee or promotional budget, that fact alone will not reduce the compensation previously agreed in favor of the Commercial User.
18. Customizable Products and Customization During the Live
A Live Shopping session may feature Customizable Products, demonstrations of the editor, design selection, printing techniques or customization processes. The options shown must reasonably correspond to the features, materials, variants and restrictions available for the Product.
Where customization is performed or selected by the Buyer, the specifications confirmed in the Order must be used for manufacturing, printing or preparation. No participant may unilaterally substitute any confirmed text, image, design, size, color, material, technique or other essential characteristic.
Application of a Live Promotion to a Customizable or Customized Product does not by itself alter the rules applicable to exchanges, statutory warranty, withdrawal, returns or other rights. These matters will be handled in accordance with the Exchanges and Returns Policy and applicable law.
19. Orders, Delivery, Exchanges, Warranty and Other Buyer Rights
Orders placed during Live Shopping will have the same nature as other Orders placed through the Marketplace, without prejudice to any specific promotional conditions validly applied.
Purchasing a Product with a Live Shopping discount or benefit does not eliminate or reduce the Buyer’s rights regarding delivery, quality, fitness for purpose, safety, statutory warranty, withdrawal, exchanges, returns, refunds, payment reversal or other remedies provided by applicable law.
Post-purchase requests will be handled through the channels enabled by FUERA DEL MOLDE and in accordance with the Exchanges and Returns Policy, the Delivery and Shipping Policy and any other applicable conditions.
The Buyer will not be required to determine the legal classification of a problem. Where a defective, incorrect or incomplete Product, a Product different from the one requested, or a Product that does not correspond to confirmed specifications is reported, FDM will assess the facts and manage or coordinate the applicable legal framework and remedy.
20. Interaction, Comments and Moderation
Viewers may interact through comments, questions, reactions, polls or other features enabled by the Streaming Channel.
Users must comply with the FUERA DEL MOLDE Content and Community Guidelines and the applicable rules of the Streaming Channel. FDM may moderate, hide, remove or restrict interactions involving spam, fraud, impersonation, threats, harassment, discrimination, illegal content, infringement of third-party rights, improper disclosure of personal data or any other conduct incompatible with its policies.
Viewer contributions do not represent FUERA DEL MOLDE and do not modify the commercial conditions of a Promotion. Communications made by presenters or official accounts must be interpreted together with the Live-Specific Conditions, Product information and the purchase actually confirmed.
21. Recording, Rebroadcasting and Post-Live Content
FUERA DEL MOLDE may record, retain, rebroadcast, edit or publish excerpts from a Session where it holds the corresponding rights and authorizations and such uses are compatible with the disclosed purposes.
Subsequent availability of a recording, rebroadcast, clip, story, publication, advertisement or derivative content will not automatically extend the validity of Promotions that have ended.
Where a recording remains available after an offer expires, FDM must take reasonable measures to allow the User to identify that the promotional benefit is no longer valid, particularly where prices, codes, countdowns, urgency messages or temporary discounts remain visible.
Usernames and comments publicly displayed by a platform during the broadcast may appear incidentally in the recording as part of the ordinary operation of the Streaming Channel. Any subsequent use for a different purpose will be subject to the Privacy Policy and the applicable authorizations or legal bases.
Merely viewing a Live Shopping session does not constitute authorization for commercial use of a viewer’s image or voice. Where a viewer is invited to participate by audio, video or on-camera appearance and that participation is intended to be retained or reused for subsequent promotional purposes, FDM must have the authorization or other legal basis necessary for that use.
22. Intellectual Property, Music, Content and Image Rights
Designs, images, photographs, videos, music, trademarks, logos, illustrations, texts, animations and other Content used during Live Shopping must be covered by the rights, licenses, permissions or authorizations necessary for their broadcast, promotion and use.
Commercial Users and other participants will remain responsible for the Content they provide or request to use, in accordance with the FUERA DEL MOLDE Intellectual Property and Image Rights Policy.
The technical ability to play music, display a design, share a screen or use material during a broadcast does not by itself constitute authorization to exploit it. FDM may remove, mute, restrict or modify elements of the broadcast where there is a claim, potential infringement, Streaming Channel restriction or reasonable compliance need.
23. Personal Data Processing
Personal data obtained during registration, viewing, interaction, purchasing, handling of requests or commercial participation will be processed in accordance with the FUERA DEL MOLDE Privacy and Personal Data Processing Policy and applicable law.
Viewing a Live Shopping session or making a purchase will not by itself be interpreted as authorization to receive future advertising where that purpose requires separate authorization.
Viewers must avoid posting passwords, full payment-instrument numbers, identification documents, private addresses, sensitive data or other personal information that is unnecessary for participation in public spaces.
Where a Streaming Channel belongs to a third party, that provider may process information in accordance with its own policies. FUERA DEL MOLDE will process information it receives or controls within the scope of its functions and responsibilities.
24. Technical Failures, Interruptions and Contingencies
A broadcast may be affected by connectivity failures, Internet interruptions, unavailability of social networks, third-party platform errors, audio or video problems, synchronization delays, maintenance, security incidents or other technical circumstances.
Where a technical failure prevents a Live Promotion from being conducted under the announced conditions, FUERA DEL MOLDE may adopt corrective measures that do not reduce rights already acquired or worsen the conditions of validly confirmed Orders. Where favorable to consumers, FDM may extend the validity period, reinstate the benefit or establish an equivalent substitute period, clearly communicating this through reasonably appropriate channels. A technical failure does not authorize retroactive shortening of the announced validity period, an increase in price, a reduction of the benefit or disregard of a Promotion already incorporated into a confirmed Order.
If a failure makes it impossible to determine with certainty whether an Order was generated within the promotional period, FDM may review available technical records, including the Order date and time, cart status, payment request, system confirmations and other relevant traceability, in order to determine the appropriate solution.
25. Fraud Prevention and Misuse of Promotions
Codes, discounts, coupons and other Live Shopping benefits must be used in good faith and in accordance with their Live-Specific Conditions.
FUERA DEL MOLDE may conduct reasonable verification where there are objective indications of automated use, improper duplication of benefits, fraudulent account creation, manipulation of Orders, payments or inventory, use of false information, resale intended to evade promotional limits or other abusive conduct.
Fraud-prevention measures must be proportionate and may not be used to disregard rights legitimately acquired by Buyers acting in good faith or to limit mandatory rights recognized by law.
26. Contests, Sweepstakes and Other Activities
Where a contest, sweepstakes, promotional game, prize giveaway or other activity requiring specific rules is conducted during Live Shopping, the activity must have separate or clearly differentiated Terms and Conditions establishing, as applicable, the organizer, participation requirements, validity period, mechanics, prizes, selection criteria, method for communicating results and delivery conditions.
Before launching an activity subject to the rules governing promotional games, raffles or games of chance, FUERA DEL MOLDE must determine whether authorization, a permit, supervision or a procedure before Coljuegos or the competent territorial authority is required and, where required, obtain it before conducting the activity.
Simply viewing or participating in Live Shopping will not automatically constitute enrollment in such activities unless the specific rules expressly provide otherwise and the corresponding requirements are met.
27. Modification, Postponement or Cancellation of a Session
FUERA DEL MOLDE may modify, postpone, interrupt or cancel a broadcast where necessary for operational, technical, commercial, legal, security, intellectual-property, Product-availability, force-majeure or other reasons that make it impossible or inadvisable to continue the event under the planned conditions.
Modification, postponement or cancellation of a Session does not authorize FUERA DEL MOLDE or any other participant to unilaterally reduce objective and specific conditions of a Promotion that have already become binding. Where the Session must be modified or canceled before it begins, FDM will seek to communicate this promptly through the same channels or with reasonably equivalent reach to those used to announce it and will determine the treatment of associated Promotions in accordance with their conditions and applicable law. Validly confirmed Orders and benefits already incorporated into them will retain the conditions applicable when the transaction was entered into unless the law provides otherwise or a subsequent solution is more favorable to the Buyer.
28. Retention of Information and Evidence
FUERA DEL MOLDE may retain, in a proportionate manner and in accordance with its policies and applicable law, information necessary to demonstrate the conditions of Live Shopping sessions and their Promotions, including recordings, advertising materials, Live-Specific Conditions, dates, schedules, prices, Products, codes, publications, communications and records related to transactions.
Commercial Users may be required to retain and provide, where applicable, information regarding inventory, prices, specifications, production, authorization of Promotions, dispatch, quality or any other supporting evidence reasonably necessary to reconstruct an Order, handle a claim or verify a condition communicated during the Live.
Where records contain personal data, their retention will be subject to the Privacy and Personal Data Processing Policy and the applicable legally valid purposes and retention periods.
29. Governing Law, Consumer Rights and Authorities
These Terms will be governed by the laws of the Republic of Colombia. No provision may be interpreted as a waiver, limitation or reduction of non-waivable rights recognized for consumers or of obligations imposed directly by law on FUERA DEL MOLDE, Sellers, Producers, suppliers or other participants.
Use of FUERA DEL MOLDE’s channels does not limit the right of the consumer or any other person with standing to bring a matter before the Superintendence of Industry and Commerce (SIC), the judicial authorities or any other competent authorities where appropriate.
30. Updates, Effective Date and Contact
FUERA DEL MOLDE may update these Terms where necessary due to legal, regulatory, technological, operational, commercial or security changes, or changes related to the evolution of Live Shopping features.
Where an amendment is material to participants’ rights or obligations, FDM will seek to communicate it through the Marketplace, Help Center, registered email address or another reasonable channel before it takes effect, unless a rule, authority order or urgent situation requires immediate application.
Amendments will apply prospectively and will not by themselves alter the conditions of already confirmed Orders or Promotions already used, unless the law requires otherwise or a subsequent condition is favorable and legally applicable.
These Terms will take effect upon their official publication by FUERA DEL MOLDE unless a later date is stated. FDM may retain prior versions and evidence of publication or acceptance dates as necessary to demonstrate the conditions applicable to each Session, Promotion or Order.
